  1. General Provisions

These general terms and conditions of sale apply to all sales of products purchased through the website.

The use of the distance selling service described in these General Terms and Conditions is reserved for consumers, understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activity, if any, and for companies that must provide the relevant VAT number for the issue of the sales invoice.

The language available to conclude the contract is Italian.

The Customer must carefully read the General Conditions that have been made available to him on the Site, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.

Contracts concluded through the Website are governed by Italian law and, in particular, by Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”) and by Legislative Decree no. 70 of 9 April 2003 (hereinafter, “Ecommerce Decree”).

The prices of the products include all taxes and duties. Delivery costs are indicated separately. All prices are in Euro.


  1. Ordering Products

The essential characteristics and prices of the Products are given in the offer for each Product.

For the purchase of Products, the Customer must fill in and send to FRANTOIO OLEARIO BIGUCCI SNC the order form in electronic format, following the instructions contained in the Website. The Customer must place the Product in the “shopping cart” and, after reading the General Conditions, with particular reference to the contribution to delivery costs and how to exercise the right of withdrawal, and the Privacy Policy, must select the desired method of payment and choose the option “send order”.

Before submitting his purchase order, the Customer will have the opportunity to correct any errors in data entry by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to modify the quantity of the Products he intends to purchase by adding or removing one or more Products from the “cart”.

By sending the order, the Customer acknowledges and declares that he has read all the information provided to him during the purchase process and accepts the General Conditions in full.

The Customer will be able to view and follow the status of his order through the “Orders” area of his account.

FRANTOIO OLEARIO BIGUCCI SNC reserves the right to evaluate the acceptance of orders received.
FRANTOIO OLEARIO BIGUCCI SNC will inform the Customer of any impossibility to accept the orders received within 30 days from the day after the Customer has sent the order to FRANTOIO OLEARIO BIGUCCI SNC and will refund any sums already paid by the Customer for the payment of the supply.


  1. Methods of payment

the Customer may pay the price of the Products and the relevant delivery costs by paypal and credit card.

FRANTOIO OLEARIO BIGUCCI SNC accepts payments made with the following credit cards:

  • Visa
  • MasterCard
  • Diners

The transaction shall be debited from the Customer’s credit card only after: a)
the credit card data have been verified,
b) the debit authorisation has been received from the company issuing the credit card used by the Customer
, and c) the availability of the Product has been confirmed by FRANTOIO OLEARIO BIGUCCI SNC.

Other forms of payment are to be agreed on the basis of the size of the orders received and at the discretion of Frantoio Oleario Bigucci snc.



  1. Confirmation of order receipt

In accordance with the provisions of Article 53 of the Consumer Code, the Customer shall receive, at the time of execution of the contract, by email, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, the essential characteristics of the product ordered, its price, the amount paid, the existence of the right of withdrawal – with an indication of the timeframe and method for returning the goods – the geographical address to lodge any complaints and information on the existing assistance services and commercial guarantees.


  1. Ineffectiveness of the order

No contract shall be deemed to be concluded between FRANTOIO OLEARIO BIGUCCI SNC and the Customer if FRANTOIO OLEARIO BIGUCCI SNC has reasonable grounds to believe that the Customer is not acting on the basis of an effective and genuine interest in purchasing the products ordered, or is abusively exercising the right of withdrawal recognised by art. 12 below.
In such cases, the order placed by the Customer shall be considered ineffective. FRANTOIO OLEARIO BIGUCCI SNC will send the Customer, by e-mail, a communication stating the non-conclusion of the Contract, also taking care of the cancellation of any charges and/or expenses incurred by the Customer.


  1. Transport and delivery

The Products purchased on the Website will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request delivery of the products to a natural person of his/her choice, whose residence or domicile is located within the Italian territory. At the time of delivery, the signature of an adult over the age of 18 will be required. Deliveries to P.O. boxes will not be made.

Delivery costs are borne by the Customer and are clearly indicated on the Site and in the order form.

All purchases shall be delivered by express courier (hereinafter referred to as “Courier”) from Monday to Friday, excluding public holidays and national holidays. FRANTOIO OLEARIO BIGUCCI SNC is not responsible for unforeseeable delays.

FRANTOIO OLEARIO BIGUCCI SNC may send the Customer a confirmation e-mail once the Products have been dispatched, specifying the tracking number of the shipment through which it will be possible to view, after entering the Courier’s website, the status of the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a maximum period of 10 (ten) days from the day after the Customer has sent the order to FRANTOIO OLEARIO BIGUCCI SNC , unless FRANTOIO OLEARIO BIGUCCI SNC communicates – within the same period, by e-mail – the impossibility of delivering the ordered goods due to the unavailability, even temporary, of the Products. In case of such communication, FRANTOIO OLEARIO BIGUCCI SNC will refund any amounts already paid by the Customer for the payment of the supply.

In the event that, following communication by FRANTOIO OLEARIO BIGUCCI SNC of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the same shall be refunded as soon as possible, and in any case no later than 30 (thirty) days from the day after the Customer has sent the order to FRANTOIO OLEARIO BIGUCCI SNC .

For the delivery of the goods, the presence of the Customer or of a person appointed by him/her at the recipient’s address indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the transport document and that the package is intact or not altered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately notified by means of a written control reservation on the Courier’s proof of delivery. Once the Courier’s document has been signed, the Customer may not raise any objection regarding the external characteristics of the package delivered.


  1. Right of withdrawal and returns

FRANTOIO OLEARIO BIGUCCI SNC wishes to guarantee complete Customer satisfaction.
Pursuant to article 64 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, by returning, at his/her own expense, the Products purchased through the Website within 14 (fourteen) working days from the date of receipt of the Products.

The products must be returned in their original packaging, undamaged and not tampered with as per art. 59 of Legislative Decree 21 February 2014, no. 21.

FRANTOIO OLEARIO BIGUCCI reserves the right to assess the integrity of the returns received.

To exercise the right of withdrawal, the Customer must send a communication within 14 working days from the date of receipt of the goods. This communication must be sent by email to or, you can request the right of withdrawal form from that email.

Once the above-mentioned communication has been received, the customer service will provide the customer with instructions on how to return the goods, which must be received at our premises within 7 days of authorisation.

This communication must contain:

  • a) the manifestation of willingness to make use of the right of withdrawal pursuant to Article 64 of the Consumer Code (Legislative Decree 206/2005);
  • b) an indication of the Products to be returned;
  • c) the order number issued at the time of purchase;


In case of exercise of the right of withdrawal, FRANTOIO OLEARIO BIGUCCI SNC will refund the full price of the Products provided that they are returned by the Customer in a normal state of preservation and only if the return instructions above are correctly followed.

FRANTOIO OLEARIO BIGUCCI SNC reserves the right to refuse the return of those Products that do not comply with these requirements. Refunds will be made with the same payment method used for the purchase.

The delivery costs for the return of the Products shall be borne by the Customer; any costs incurred by the Customer for the return shall not be reimbursable.

FRANTOIO OLEARIO BIGUCCI snc undertakes to promptly reimburse the Customer within and no later than 14 days from the date of return of the Products.

FRANTOIO OLEARIO BIGUCCI SNC will send an e-mail confirming the refund.

FRANTOIO OLEARIO BIGUCCI SNC shall not be responsible for the reimbursement or compensation of Products returned but which have never been received by FRANTOIO OLEARIO BIGUCCI SNC due to loss, theft or damage not attributable to FRANTOIO OLEARIO BIGUCCI SNC.

Should the Customer wish to modify or cancel the order submitted, he must promptly send an e-mail to Once the Product has been shipped, the order cannot be cancelled or modified until the goods shipped have been returned to FRANTOIO OLEARIO BIGUCCI SNC.

In this case, reference shall be made to the regulations on returns described above.

  1. Product Replacement

FRANTOIO OLEARIO BIGUCCI SNC intends to provide Customers with the possibility to replace the Products purchased through the Site.

Shipping costs for the return of the Product shall be borne by the Customer.

  1. Conformity defects

The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer is entitled to the restoration, without charge, of the conformity of the goods by repair or replacement or an appropriate reduction in price or termination of the contract. The Customer loses these rights if he does not report the lack of conformity to FRANTOIO OLEARIO BIGUCCI SNC within one month from the date on which he discovered the defect. The action aimed at asserting defects not fraudulently concealed by FRANTOIO OLEARIO BIGUCCI SNC is prescribed, in any case, within twenty-four months from delivery of the goods.

However, it is not possible to guarantee the complete absence of errors.

FRANTOIO OLEARIO BIGUCCI SNC reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update the information at any time without prior notice.

  1. Applicable law and jurisdiction

These General Terms and Conditions shall be governed by and construed in accordance with the laws of Italy.

For disputes arising from the interpretation, validity and/or execution of these General Terms and Conditions, the mandatory territorial jurisdiction shall be that of the judge of the place of residence or domicile of the consumer, if located in Italian territory.
